Partner Terms

These terms govern the contractual relationship between ExplWorld, a trading name of by veru s.r.o., Lermontovova 911/3, 811 05 Bratislava, Slovak Republic, company number 53736222, VAT number SK2121475048, registered in Slovakia, and the Partner.

They apply to the paid programmes ExplWorld Verified, ExplWorld Verified Plus, Field Tested, Country Partner and Global Partner. They do not apply to affiliate placements or sponsored stories, which are agreed separately.

The Partner confirms that it enters this agreement in the course of business. The Partner is not a consumer, and the statutory 14-day right of withdrawal for consumers does not apply.

The Partner buys: the execution of the verification process, the creation and maintenance of a profile, placement on ExplWorld pages for the duration of the term, and a tracked outbound link.

The following are expressly not for sale and are not part of this agreement:

• the content or tone of any editorial assessment
• any placement above the entry-rules section
• any appearance in the results of ExplWorld tools
• the removal of truthful and relevant content
• use of the ExplWorld name outside the ExplWorld website

ExplWorld verifies: legal existence, required licences and registrations, current operation, working contact and booking channels, and the absence of an unresolved pattern of complaints in precisely defined areas.

ExplWorld does not verify prices, the quality of the experience, availability, or the course of any individual booking.

The Partner undertakes to provide truthful supporting materials. Providing an untruthful document is grounds for immediate termination without refund.

• Prices are yearly and exclusive of VAT.
• Invoicing is once, at the start of the term; payment is due within 14 days.
• For supplies within the EU to a business with a valid VAT ID, the reverse-charge mechanism applies.
• Placement activates only after payment is received.

If the Partner fails verification:

• the profile is not published
• the fee is refunded less a cancellation fee of 40% of the price, which pays for the verification work already carried out
• the reason is communicated to the Partner in writing

If the Partner withdraws after the process has begun but before publication: the same cancellation fee applies.

If the Partner withdraws after publication: the fee is not refunded, and the placement runs to the end of the term.

Field Tested: the fee covers the journey and the editor's time. If the visit goes badly, the Field Tested mark is not awarded, the fee is not refunded, and the existing Verified listing is reassessed on what was found. Travel costs are invoiced separately and are never refunded.

Field Tested is the only category without a refund, because its costs are actually incurred and cannot be recovered. A paid visit that could only ever end well would be worth nothing to the person reading about it.

• The term is 12 months from publication.
• Nothing renews automatically. Before the term ends, re-verification takes place.
• If the Partner fails re-verification, the placement is removed and no pro-rated refund arises.
• The founding rate is conditional on uninterrupted holding of the seat. It lapses if the term is interrupted for any reason.

ExplWorld retains sole discretion over content. The Partner has no right to approve content, to comment before publication, or to request a change of assessment.

The Partner may point out a factual inaccuracy - an incorrect piece of data, not disagreement with an assessment. ExplWorld will correct an inaccuracy.

The entry-rules dataset, visa data and safety information are outside the subject of this agreement, and the partnership has no influence on them.

ExplWorld may suspend or remove a placement without refund if the Partner:

• ceases to meet the conditions of verification
• loses a required licence
• provided an untruthful supporting document
• is the subject of a demonstrated pattern of complaints in the areas defined in section 03
• uses the ExplWorld name contrary to section 09

The Partner may state its Verified status through its own channels during the term, giving the year of verification. The Partner may not: modify the mark, claim a higher tier than was granted, use a domain or subdomain containing the ExplWorld name, or imply a partnership after the term has ended.

The Partner grants ExplWorld a non-exclusive licence to use the supplied photographs and materials on ExplWorld websites and in ExplWorld communications for the duration of the agreement and for a reasonable period afterwards for archival purposes (the archive, earlier issues of the Border Report). The Partner confirms it holds the rights to the supplied materials.

ExplWorld is not a party to the relationship between the Partner and the traveller, is not a booking intermediary, and is not responsible for the performance of the Partner's services.

ExplWorld's liability towards the Partner is limited to the fee paid for the current term. Nothing in these terms excludes or limits liability that cannot lawfully be excluded.

The Partner's contact details are processed to perform this agreement. Details are in the Privacy Policy. Outbound-click tracking is aggregated and stores no IP address, no user agent and no identifiers.

Slovak law governs these terms. The courts having jurisdiction are determined by the registered seat of ExplWorld.

ExplWorld may change these terms with effect for new and renewed terms. A running term is governed by the wording in force when it began. The version and its effective date are stated in the header of this document and archived.
